FCC EEO public file report: what to post, and when
Short answer. A station whose employment unit has five or more full-time employees posts an EEO public file report every year, on the anniversary of the date its license renewal application is due, in its public file and on its website if it has one (47 CFR 73.2080(c)(6), (d)).
1. The official method
- When. Annually, on the anniversary of the date the station is due to file its renewal application (47 CFR 73.2080(c)(6)). The renewal is due by the first day of the fourth full calendar month before the license expires (73.3539(a)), so for radio stations in Maryland, the District of Columbia, Virginia and West Virginia, whose licenses expire October 1, 2027, the anniversary is June 1.
- Where. In the station's public file kept under 73.3526 or 73.3527, and on its website if it has one.
- What it contains. For the preceding year: a list of all full-time vacancies filled by the station employment unit, by job title; the recruitment sources used for each, with name, address, contact person and telephone number; the source that referred each hire; the total number of persons interviewed for full-time vacancies and the number referred by each source; and a list and brief description of the outreach initiatives under (c)(2). A station that acquired its station during the year reports from the acquisition date.
- Who. Employment units with fewer than five full-time employees are exempt from paragraphs (b) and (c) (73.2080(d)). A full-time employee is a permanent employee whose regular schedule is 30 hours a week or more; a station employment unit is a station or a group of commonly owned stations in the same market that share at least one employee (73.2080(e)).
- How long. The EEO file stays in the public file until final action on the station's next renewal application (73.3526(e)(7)). The recruitment records behind the report are kept until after the renewal application for the term in which the vacancy was filled or the initiative happened is granted (73.2080(c)(5)); they go to the FCC only on request, and the FCC audits about five percent of licensees each year (73.2080(f)(4)).
The first radio groups, with the date each year's report is due:
| States (radio) | EEO report due each year on | Renewal due |
|---|---|---|
| MD, DC, VA, WV | June 1 | Jun 1, 2027 |
| NC, SC | August 2 | Aug 2, 2027 |
| FL, PR, VI | October 1 | Oct 1, 2027 |
| AL, GA | December 1 | Dec 1, 2027 |
2. Where doing it by hand stops
Writing the report is the station's own work: only you know the vacancies, sources and interviews. What goes wrong by hand is the record: one report for each anniversary of the 8-year term, each posted on time, still in the file and on the website. Finding out means opening the public file, listing the EEO reports, reading their upload dates and comparing them with every anniversary since the term began.
Airtally does that comparison for the call sign you type: for each anniversary of the term it finds the EEO report in the FCC public file by its name and upload date, and marks it on time, late, missing or not yet due; whether the station is exempt is your input, because the employee count is not public. It does not read the report, does not check the website, and does not write the report for you.
